DuPage County State’s Attorney Robert Berlin and Oak Brook Chief of Police Brian Strockis announced today that charges have been filed against five Venezuelan migrants for allegedly stealing more than $2,000 worth of merchandise from two Oak Brook stores. Miguel Ortiz-Griman, 24 (d.o.b. 5/22/1999), Felix Garcia-Diaz, 25 (d.o.b. 1/4/1999), Daniel Fernandez-Rodriguez, 18 (d.o.b. 10/18/2005), Samuel Alvarez-Garcia, 25 (d.o.b. 10/31/1998) and Oswaldo Rivero-Herrera, 33 (d.o.b. 3/20/1990), all of Venezuela with no known permanent address, appeared at First Appearance Court this morning where Judge Joshua Dieden denied the State’s motion to detain the men pre-trial. All five defendants are charged with one count of Burglary (Class 2 Felony) and one count of Retail Theft (Class 3 Felony).
On February 20, 2024, at approximately 7:57 p.m., a citizen reported to authorities he allegedly observed four men stealing merchandise from the Nike store located at 2155 W. 22nd Street. Officers with the Oak Brook Police Department located the vehicle allegedly involved parked outside the Ulta store located in the same mall. Officers conducted surveillance on the vehicle, allegedly occupied by Ortiz-Griman and Garcia-Diaz, and a short time later allegedly observed Fernandez-Rodriguez, Alvarez-Garcia and Rivero-Herrera exit the Ulta store and enter the vehicle. Officers attempted to initiate a traffic stop but the vehicle allegedly drove around the officer’s squad car before being boxed in by other officers. All five men were taken into custody at this time. It is alleged that the men stole nine fragrance items from the Ulta store with a value of approximately $1,331 as well as shoes and a hat from the Nike store valued at approximately $726.98.
“It is alleged that when the defendants were taken into custody, they were laughing at the officers and not taking this matter seriously,” Berlin said. “While the defendants in this case may not take the charges against them seriously, I can assure you, in DuPage County we take these allegations very seriously. Make no mistake, law enforcement in DuPage County remains vigilant and if you steal from any of our retail establishments, you will be arrested, charged and prosecuted. I commend the Oak Brook Police Department for their continued efforts in protecting our local businesses as well as the individual who alerted the authorities. I also thank Assistant State’s Attorneys Bethany Jackson and Michael Pingaj for their work in securing charges against these five men.”
“These five arrests add to the significant number of illegal migrant arrests we have had in the past four months,” Strockis said. “We will continue to be pro-active in our efforts in keeping our community safe. Much of society is tired of hearing about these types of crimes and I’d like to thank the witness for being alert and contacting the police in this incident. I’d also like to thank State’s Attorney Bob Berlin and his office for their continued guidance and appropriate charges in these incidents.”
The next court date for all five defendants is scheduled for March 18, 2024, for arraignment in front of Judge Mia McPherson.
Members of the public are reminded that this complaint contains only charges and is not proof of the defendants’ guilt. The defendants are presumed innocent and are entitled to a fair trial in which it is the government’s burden to prove their guilt beyond a reasonable doubt.
El fiscal estatal del condado de DuPage, Robert Berlin, y el jefe de policía de Oak Brook, Brian Strockis, anunciaron hoy que se han presentado cargos contra cinco inmigrantes venezolanos por presuntamente robar más de $2,000 en mercancías de dos tiendas de Oak Brook. Miguel Ortiz-Griman, 24 (fecha 22/05/1999), Félix García-Díaz, 25 (fecha 4/1/1999), Daniel Fernández-Rodríguez, 18 (fecha 18/10/2005), Samuel Álvarez-García, 25 (f.o.b. 31/10/1998) y Oswaldo Rivero Herrera, 33 (f.f. 20/3/1990), todos ellos de Venezuela sin domicilio permanente conocido, comparecieron ante el Tribunal de Primera Audiencia esta mañana donde el juez Joshua Dieden negó la moción del Estado de detener a los hombres antes del juicio. Los cinco acusados están acusados de un cargo de robo (delito grave de clase 2) y un cargo de robo en comercio minorista (delito grave de clase 3).
El 20 de febrero de 2024, aproximadamente a las 7:57 p.m., un ciudadano informó a las autoridades que presuntamente observó a cuatro hombres robando mercancía de la tienda Nike ubicada en 2155 W. 22nd Street. Los oficiales del Departamento de Policía de Oak Brook localizaron el vehículo presuntamente involucrado estacionado afuera de la tienda Ulta ubicada en el mismo centro comercial. Los oficiales vigilaron el vehículo, supuestamente ocupado por Ortiz-Griman y García-Díaz, y poco tiempo después supuestamente observaron a Fernández-Rodríguez, Álvarez-García y Rivero-Herrera salir de la tienda Ulta y entrar al vehículo. Los oficiales intentaron iniciar una parada de tráfico, pero el vehículo supuestamente pasó alrededor de la patrulla del oficial antes de ser encerrado por otros oficiales. Los cinco hombres fueron detenidos en ese momento. Se alega que los hombres robaron nueve artículos de fragancia de la tienda Ulta con un valor de aproximadamente $1,331, así como zapatos y un sombrero de la tienda Nike valorados en aproximadamente $726,98.
“Se alega que cuando los acusados fueron detenidos, se reían de los agentes y no se tomaban el asunto en serio”, afirmó Berlin. “Si bien es posible que los acusados en este caso no tomen en serio los cargos en su contra, les puedo asegurar que en el condado de DuPage nos tomamos estas acusaciones muy en serio. No se equivoque, las autoridades del condado de DuPage permanecen alerta y si roba en cualquiera de nuestros establecimientos minoristas, será arrestado, acusado y procesado. Felicito al Departamento de Policía de Oak Brook por sus continuos esfuerzos para proteger a nuestros negocios locales, así como a la persona que alertó a las autoridades. También agradezco a los fiscales estatales adjuntos Bethany Jackson y Michael Pingaj por su trabajo para obtener cargos contra estos cinco hombres”.
“Estos cinco arrestos se suman al número significativo de arrestos de inmigrantes ilegales que hemos tenido en los últimos cuatro meses”, dijo Strockis. “Continuaremos siendo proactivos en nuestros esfuerzos para mantener segura a nuestra comunidad. Gran parte de la sociedad está cansada de oír hablar de este tipo de delitos y me gustaría agradecer al testigo por estar alerta y contactar a la policía en este incidente. También me gustaría agradecer al fiscal estatal Bob Berlin y su oficina por su continua orientación y cargos apropiados en estos incidentes”.
La próxima fecha de audiencia para los cinco acusados está programada para el 18 de marzo de 2024, para la lectura de cargos ante la jueza Mia McPherson.
Se recuerda al público que esta denuncia contiene sólo cargos y no es prueba de la culpabilidad de los acusados. Se presume que los acusados son inocentes y tienen derecho a un juicio justo en el que corresponde al gobierno demostrar su culpabilidad más allá de toda duda razonable.
