DuPage County State’s Attorney Robert Berlin and West Chicago Chief of Police Colin Fleury announced today that Judge Joshua Dieden has granted the State’s motion to detain a West Chicago man accused of sexually abusing a minor female earlier this month. Joseph Simmons, 26 (d.o.b. 1/15/1999) of the 300 block of Chippewa Lane, appeared in First Appearance Court this morning charged with two counts of Aggravated Criminal Sexual Abuse, a Class 2 Felony. Simmons, a registered sex offender, is currently on probation for three separate offenses and on pre-trial release for burglary.
On April 7, 2025, the victim, a sixteen-year-old female from Chicago, was found alone at a West Chicago gas station after she had not been home for three days. After authorities spoke with the victim, it is alleged that on Friday, April 4, 2025, the victim had taken the train from her home to West Chicago to meet with Simmons, whom she had met in November 2024, in Chicago. It is alleged that weekend, the victim wanted to return home, but Simmons would not allow her to leave his residence and instead took her cellular phone and forced the girl to perform oral sex on him. On April 7, 2025, Simmons took the girl to the train station and then back to another West Chicago residence. While at the residence, Simmons fled the scene. Following an investigation into the matter, West Chicago police officers located Simmons in a car that had been reported stolen. It is alleged that when officers found Simmons, he attempted to flee the police on foot by climbing over a barbed wire fence but was unsuccessful and apprehended at that time.
“The allegations against Mr. Simmons are extremely alarming,” Berlin said. “The safety and well-being of our children remains a top priority of my administration, and my office stands ready to prosecute, to the fullest extent of the law, anyone accused of the type of behavior alleged against Mr. Simmons. I thank the West Chicago Police Department for their investigation into this matter and for the successful apprehension of the defendant. I also thank the DuPage County Children’s Center as well as Assistant State’s Attorney Jaclyn McAndrew for her work not only in this case but for their ongoing efforts in protecting our children.”
“The alleged actions of this defendant are disturbing, and I am pleased that the Court detained him pending his trial,” Fleury said. The officers of the West Chicago Police Department will continue to work tirelessly to investigate these cases along with our partners at State’s Attorney Bob Berlin’s office and the Children’s Advocacy Center.”
Simmons’ next court appearance is scheduled for May 19, 2025, in front of Judge Mia McPherson.

Joseph Simmons, de 26 años (nacido el 15/01/1999), residente de la cuadra 300 de Chippewa Lane, compareció esta mañana ante el Tribunal de Primera Instancia acusado de dos cargos de Abuso Sexual Criminal Agravado, un delito grave de Clase 2. Simmons, delincuente sexual registrado, se encuentra actualmente en libertad condicional por tres delitos distintos y en libertad provisional por robo.
El 7 de abril de 2025, la víctima, una joven de dieciséis años de Chicago, fue encontrada sola en una gasolinera de West Chicago después de haber estado ausente durante tres días. Tras hablar con la víctima, se alega que el viernes 4 de abril de 2025, esta tomó el tren desde su domicilio hasta West Chicago para reunirse con Simmons, a quien había conocido en noviembre de 2024 en Chicago. Se alega que ese fin de semana, la víctima quiso regresar a casa, pero Simmons no le permitió salir de su residencia y, en su lugar, le quitó el teléfono celular y la obligó a practicarle sexo oral. El 7 de abril de 2025, Simmons llevó a la niña a la estación de tren y luego a otra residencia en West Chicago. Mientras se encontraba en la residencia, Simmons huyó del lugar.
